Personal Fundraiser Terms of Service

The following Personal Fundraiser Terms (the “Terms”) apply when you use of any of the features (each a “Personal Fundraising Feature”) Facebook makes available to raise and collect funds (“Donations”) from Facebook users (“Donors”) for personal causes.
  1. General Terms
    1. We may block or restrict your access to Personal Fundraising Features if we detect activity that negatively impacts the platform.
    2. You can only create fundraisers or collect Donations if you are at least 18 years old and a resident of a country where we offer the Personal Fundraising features.
    3. You agree to provide Facebook any information we may request in connection with your use of the Personal Fundraising Features.
  2. Restrictions
    1. Follow the Personal Fundraiser Category Policy.
    2. You can only use the Personal Fundraising Features for personal, family or household purposes.
    3. Don’t seek or accept compensation for using the Personal Fundraising Features.
    4. Don’t offer or provide perks, rewards, or securities to Donors in exchange for Donations.
    5. Don’t use the Personal Fundraising Features to fundraise for nonprofit or charitable organizations, or for political purposes.
    6. Don’t suggest that Donations will be tax deductible.
    7. Do not use the Personal Fundraising Features to attempt to raise funds for activities, individuals or entities that are located in a country or region that is subject to comprehensive U.S. sanctions law or that would otherwise violate applicable U.S. or non-U.S. trade sanctions laws.
  3. Roles of Facebook and Payment Processor
    1. Facebook does not process the payment of Donations. Payments will be processed by a third party payment processor (the “Payment Processor”), subject to the Payment Processor's terms, which cover the Payment Processor’s rights to put reserves or holds on Donations and reclaim funds from you in case of a refund or chargeback. Facebook does not control or guarantee payments or payment timelines.
    2. Facebook may block or restrict your use of the Personal Fundraising Features at the Payment Processor’s request.
    3. Facebook offers customer support for the Personal Fundraising Features, and may communicate with the Payment Processor on your behalf or have you contact the Payment Processor directly to address certain issues. Facebook is not liable for disputes between you and the Payment Processor.
    4. Facebook may add or switch Payment Processors at any time. You agree to transfer your payment account and underlying funds to any other Payment Processors designated by Facebook to continue using the Personal Fundraising Features.
  4. Creating a Fundraiser and Receiving Funds
    1. When you create a fundraiser, you are solely responsible for resolving disputes between yourself and other parties involved with a fundraiser. We have the right, but not the obligation, to help resolve such disputes.
    2. You must use Donations for the stated purpose of your fundraiser. You are liable to Donors for any misleading fundraisers or misuse of funds.
    3. The Payment Processor will hold Donations for all of your fundraisers in a single account. If this account goes negative, the Payment Processor may use incoming Donations to pay off the negative balance.
  5. Fees Donation recipients are responsible for a per Donation fee based on the country selected by the Donation recipient, as shown in the chart below. All fees are non-refundable and include value-added tax or similar taxes (“VAT”), but do not include taxes based on Donation receipts that you may be responsible for paying. Fees that include VAT are rounded to the nearest hundredth. In addition to the per Donation fee, the Payment Processor may charge other types of fees, as described in the Payment Processor's terms.

  7. Third Parties
    1. We provide tools to report problems you might experience with third parties while using the Personal Fundraising Features, including suspected fraud. However, for clarity, as provided in the Terms of Service we are not responsible for third parties that use the Personal Fundraising Features.
    2. The Personal Fundraiser Category Policy is provided to you solely for convenience and is not a guarantee. You may not rely on us to determine whether any fundraiser is accurately classified into a permitted category.
  8. Taxes We don’t provide tax advice, and it is solely your responsibility to assess, collect, report or remit the correct tax, if any, to the appropriate tax authority. Donations made through the Personal Fundraising Features generally are not tax-deductible under applicable law. Consult a tax professional if you have questions.
  9. Facebook Terms of Service The Personal Fundraising Features are part of the “Facebook Products” under the Terms of Service. The Terms continues to apply to your use of the Personal Fundraising Features and any other use of Facebook. Without limiting the foregoing, you agree that the provisions in the Section titled “Disputes” in the Terms of Service apply to these Terms, your use of the Personal Fundraising Features and your interaction with Donors. In the event of any conflict between these Terms and the Terms of Service, these Terms shall govern with respect to your use of the Personal Fundraising Features to the extent of the conflict. We may change or update these Terms at any time without notice as we deem necessary to the full extent permitted by law. These Terms will terminate in the event of any termination of the Terms of Service, but the following provisions will still apply: the lead-in paragraph, Sections 1.3, 2.3, 2.4, 2.6, 3.1, 3.3, 4, 5, 6, 7, and 8.
